Bengaluru: Congress leader Siddaramaiah Wednesday flayed the Mysuru police for flouting the Justice Verma Commission report in the gangrape case and demanded resignation of Home Minister Araga Jnanendra.
"The police have not obtained a statement of the rape victim and also allowed her to go with her parents to Mumbai on August 27. It is mandatory for the police to take a statement as per Justice Verma Commission report. But, they did not follow rules under the report," he told reporters in Mysuru.
The commission was constituted in the wake national outrage over the Nirbhaya rape case in Delhi.
The report states that if any officer fails to register a case of rape reported to him, or attempts to abort its investigation, commits an offence which shall be punishable as prescribed.
The rape victim, at least, Siddaramaiah further saud should have been produced before the magistrate to register a statement, Siddaramaiah said.
The 23-year-old rape victim was allegedly gangraped when she was returning from a forested area with a male accomplice on August 24 night.
Siddaramaiah also sought explanation from the police for the delay in filing an FIR, 15 hours after registering the statement of the male victim.
"Police claim that the male victim gave the statement a day after the incident, but he gave the statement the night before. There was a gap of nearly 15 hours to file an FIR. The delay is unexplained by the police," he said.
Training guns on Jnanendra, Siddaramaiah demanded his resignation for his lackadaisical attitude and childish statements.
"The home minister visited Mysuru. Soon after his arrival, he visits Chamundeshwari hills to perform pooja at a temple. Then he visits several other places. Visits his party office and then visits the crime spot. This shows how serious the home minister is," he said.
"The home minister also made a very foolish and childish and irresponsible statement that the rape victim should not have gone to the secluded place. He is unfit to be a home minister. He should immediately resign," he demanded.
Siddaramaiah said he would raise this matter in the assembly.
Earlier, Siddaramaiah visited the crime location to gain first hand information on the course of events that took place on August 24. He spent over an hour collecting details from the police and other sources.
The police have arrested six accused, including a 17-year-old juvenile, in the horrific gangrape case in Mysuru.
All the arrested accused are from Tamil Nadu, and were picked up from Tiruppur in the neighbouring state. The seventh accused is absconding.
