Doctor found guilty for pregnent woman's death; Told to pay 17.43 lakhs as fine

Puttur: A complaint has been upheld by Dakshina Kannada District Consumers Grievances Redressal Forum, regarding an obstetrician and hospital staff accused of being negligent during delivery, and thus causing the deaths of the mother and the unborn baby.

An order has been passed by the Forum, instructing doctor of a hospital at Puttur, identified as Poorna C Rao, to pay compensation of Rs. 17,43,440 to the aggrieved.

Resident of Alankaru Parari in Perabe village in the taluk, Swapna Rai, had been admitted into a hospital at Puttur on 28th December 2010 at 9:30pm and she had her last breath on the very next day on 29th December.

Even the unborn baby died in the womb. Her father, Kamalaksha Rai filed a complaint in the district consumers forum, accusing the obstetrician and hospital staff of negligence, which he claimed, had accounted for the death of his daughter and her unborn child.

It had been recorded that the cause for the death was a rare complication called amniotic fluid embolism whereas in postmortem it was revealed that she died due to acute lung defect.

Rai stated that the actual health complication, which had caused the death, had not been determined through specific processes by the obstetrician and no effort was made by them to save the patient.

He said and the forum too agreed that the child could have been saved, by operating on the deceased woman within four minutes of the heart attack.

The president of the Dakshina Kannada District Consumers Grievances Redressal Forum, Vishweshwar Bhat D, delivered the verdict stating that compensation of Rs. 17,43,440 has been ordered to be paid to the first son of the deceased and her father.
